At around 11:44 pm., Officers Andrew Sargent and James Fallon were dispatched to the parking lot of an East Side Drive residence to investigate a report of domestic assault. According to Fallon’s report, the officers met with a man in the parking lot. He stated that his live-in ex-girlfriend, Julieann Mahoney, 41, of Concord, became abusive both verbally and physically.

The man told Fallon that Mahoney was in the apartment when he arrived home and that she had been drinking heavily. He said that he went into the bathroom to shower when Mahoney entered and began punching him. He was able to push her off and get her out of the bathroom, but when he exited the bathroom and went into the living room, Mahoney began attacking him again, he said.

In his report, Fallon noted some swelling around the man’s lips and several cuts on his face. “As we continued to speak with him, I heard a door to the building open and close. He stated, ‘Officer that’s her. She’s going to her car. She’s drunk; you need to stop her,’ ” Fallon wrote.

Fallon then jogged over to Mahoney and found her opening the passenger-side door of a vehicle. According to the report, Fallon asked her to step away from the vehicle and to talk to him about what happened. Mahoney walked toward Fallon and began talking and crying, although Fallon reported that he “saw no tears.”

Fallon wrote that he asked Mahoney why she was upset. She responded that it was her boyfriend, but did not want to say anything else. When Fallon asked her to identify herself, she refused. When he asked again, Mahoney opened her purse with some difficulty and handed him her driver’s license.

Fallon said he continued to ask Mahoney what happened as she tearlessly cried. She then told Fallon that she did not want to get anyone in trouble. Fallon told Mahoney that he had been talking with her ex-boyfriend and that he was alleging that she had assaulted him.
“Mahoney yelled that she had been hit in the mouth and that she had a fat lip. I asked Mahoney to show me her lip, but she refused,” Fallon wrote. Fallon noted that Mahoney smelled like alcohol, and her movement appeared to be disjointed.

At this point, Mahoney began walking toward the alleged victim, Fallon noted. Fallon attempted to block her, but she continued walking and tried to push him aside. Fallon asked her to stop, but she continued with the same actions. Fallon then took hold of Mahoney’s wrist and told her that she was under arrest for resisting detention. Mahoney immediately attempted to pull away, causing Sargent to come over and help Fallon force Mahoney to the ground.

According to the report, he placed her in a wrist lock and attempted to get her onto her stomach so that he could handcuff her. When she resisted, Fallon wrote that Sargent pinned her arm to the ground and Fallon rolled her onto her stomach. Once pinned, Mahoney began yelling that she had a damaged rotator cuff. Fallon told her several times to stop fighting and thrashing around and her shoulder would not hurt. With Sargent’s assistance, Fallon placed Mahoney into handcuffs.

Fallon told Mahoney to remain on the ground and relax but she instead attempted to push herself off the ground with her elbows. The officers then escorted her to the cruiser, where they had difficulty getting a seatbelt on her.

At the station, Sgt. Michael Pearl approached Fallon’s cruiser and began talking to Mahoney. Fallon noticed that Mahoney did not have handcuffs on anymore. Pearl asked Mahoney where the handcuffs were, and she said that Fallon never put them on her. When she got up, the handcuffs fell from behind her and onto the seat.

Fallon wrote that Mahoney continued to be difficult in the elevator and in the booking cell. “After checking the pockets of her sweater, I asked Mahoney if the sweatpants she was wearing had any pockets. Mahoney stated, ‘I don't have anything on me.’ She then stated ‘Here look you can have my pants.’ ” Mahoney wrote. At this time she pulled down her pants, while Fallon and Pearl ordered for her to pull them back up.

The fire department medics attempted to inspect Mahoney, but she refused to have any medical attention.

Mahoney was booked for resisting detention and for two accounts of simple assault. A personal recognizance bail was set for $5,000. She is due in court on May 28.
